TERMS & CONDITIONS
These Terms & Conditions apply to all quotes, invoices, services, fabrication work, repairs, modifications, and supply of goods provided by Candyfab unless otherwise agreed in writing.
1. Acceptance of Terms
Acceptance of any quote, invoice, booking, purchase order, commencement of work, or payment of a deposit constitutes acceptance of these Terms & Conditions.
2. Quotes
Quotes are valid for 14 days unless otherwise stated. Quotes are estimates only and may be subject to change where additional labour, materials, repairs, or unforeseen circumstances arise after inspection or commencement of work.
3. Deposits
A deposit may be required prior to commencement of work. Deposits are non-refundable once materials have been ordered, work has commenced, or labour has been allocated to the project.
4. Payment Terms
Payment is due within 7 days from the invoice date unless otherwise agreed in writing. Candyfab reserves the right to withhold release of vehicles, goods, fabricated products, or completed work until payment has been received in full.
5. Late Payments
Overdue invoices may incur interest at a rate of 3% per month calculated daily, together with a fixed monthly administration fee of $35 per overdue invoice. The customer agrees to pay all reasonable debt recovery costs, collection agency fees, legal costs, and expenses incurred in recovering overdue amounts.
6. Ownership of Goods
All supplied goods, fabricated products, parts, and materials remain the property of Candyfab until payment has been received in full. Candyfab reserves the right to repossess unpaid goods where legally permitted.
7. Additional Work
Where additional work is identified after commencement, Candyfab may proceed where verbal, written, or electronic approval has been provided by the customer. Additional work will be charged accordingly.
8. Custom Fabrication & Modifications
The customer acknowledges that custom fabrication, welding, modifications and aftermarket vehicle work may vary slightly in appearance, finish, fitment, or texture. Minor cosmetic imperfections consistent with custom fabrication processes do not constitute defects.
9. Powder Coating, Painting & Finishes
Where powder coating, painting, ceramic coating, polishing, galvanising, or external finishing services are selected, finish durability may vary depending on material preparation, environmental exposure, maintenance, and use conditions. Candyfab is not responsible for corrosion, peeling, rust, coating failure, or finish deterioration resulting from customer-selected preparation methods, environmental conditions, impact damage, or inadequate maintenance.
10. Customer-Supplied Parts
Candyfab accepts no responsibility for faults, failures, delays, incompatibility, or damage arising from customer-supplied parts or materials.
11. Warranty
Warranty applies only to workmanship directly performed by Candyfab and does not cover misuse, abuse, off-road or racing use, accidental damage, neglect, normal wear and tear, third-party products, coatings or customer-supplied parts. All warranty claims must first be assessed by Candyfab before repairs are undertaken elsewhere.
12. Limitation of Liability
To the maximum extent permitted by law, Candyfab shall not be liable for indirect or consequential loss, loss of income, loss of use, towing expenses, accommodation costs, vehicle downtime, or delays arising from supply shortages, third-party services, freight delays, or unforeseen circumstances.
13. Storage & Abandoned Goods
Vehicles, trailers, or goods left unpaid or uncollected for more than 14 days after completion may incur storage fees of $25 per day unless otherwise agreed in writing. Candyfab reserves all rights available under applicable laws relating to abandoned goods.
14. Cancellations
Orders for custom-made, fabricated, modified, or special-order products cannot be cancelled once fabrication has commenced or materials have been ordered.
15. PPSA
The customer grants Candyfab a security interest in all goods supplied until payment has been made in full pursuant to the Personal Property Securities Act 2009 (Cth).
16. Governing Law
These Terms & Conditions are governed by the law of New South Wales, Australia.
By accepting a quote, invoice, booking, or proceeding with work, the customer acknowledges and accepts these Terms & Conditions.
